Our firm has extensive experience representing clients in state and federal courts utilizing all forms of post-conviction remedies, including post-conviction motions under Rule 29.15, Rule 24.035 and Rule 91 in the Missouri court system, and habeas corpus petitions filed pursuant to section 2254 and 2255 in the federal court system. Our habeas corpus and post-conviction representation extends to all types of criminal convictions. Our lawyers have even been appointed by federal courts in post-conviction matters to represent individuals on death row in a number of cases over the years. All of our lawyers have served as lead counsel in evidentiary hearings held on post-conviction matters. Our lawyers also have extensive experience in handling appeals from the denial of post-conviction motions or petitions.
Most recently, the firm represents two individuals in federal court on writs of habeas corpus challenging their death sentences. In all post-conviction matters, there are strict time deadlines and other procedural requirements that are not found in other areas of the law. A post-conviction or habeas corpus matter requires an in-depth knowledge of those requirements. Most post-conviction and habeas corpus cases require in-depth investigation into actual innocence claims, claims of ineffective assistance of trial counsel, and other trial errors or constitutional deprivations of rights. Our lawyers work with a team of private investigators who specialize in conducting post-conviction investigations.
Our experience representing clients in habeas and post-conviction cases has reinforced the importance of developing a personal relationship with our clients. We recognize that these cases are often the last effort to correct an error or deprivation of rights on behalf of our clients. We appreciate the trust our clients have placed in us knowing that the stakes are high and that not every lawyer is well-suited to post-conviction litigation.
